These Terms of Service apply when you visit mollytalksharleylistens.com or purchase products from Molly Talks, Harley Listens.
By accessing our website, creating an account or placing an order, you agree to these terms and any policies referred to in them. If you do not agree, please do not use the website.
Nothing in these terms excludes or limits rights that cannot legally be excluded, including rights under the Australian Consumer Law and mandatory consumer laws in your country.

- USING OUR WEBSITE
You must use our website lawfully and must not:

• Attempt to access another person’s account or restricted systems
• Use the website for fraudulent, unlawful or abusive activity

You must be legally capable of entering into a purchase contract or have permission from a parent or legal guardian.
- ACCOUNTS AND CUSTOMER INFORMATION
You are responsible for providing accurate, complete and current information when placing an order or creating an account.
You are responsible for keeping your login details secure. Please notify us promptly if you believe your account has been accessed without permission.
- PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to display product descriptions, photographs, colours, sizes and specifications accurately. Colours and appearance may vary slightly because of lighting, photography, device displays or production differences.
Product availability may vary between countries and suppliers. We may change or discontinue products, but this will not affect an order we have already accepted unless we contact you and offer an appropriate solution.
- PET PRODUCTS
Choose products appropriate for your pet’s size, age, health, behaviour and intended use.
Pets should be supervised when using toys, accessories or similar products. Regularly inspect products and discontinue use if they become damaged or could present a hazard.
These safety directions do not exclude or limit our responsibility for products that fail to meet applicable consumer guarantees.
- PERSONALISED AND CUSTOM PRODUCTS
You are responsible for checking names, wording, sizes, colours, photographs and other personalisation details before submitting your order.
By providing text, photographs, artwork or other material, you confirm that you own it or have permission to use it and that it does not infringe another person’s rights.
You give us and the suppliers assisting with your order a limited permission to reproduce, adjust and use that material only as reasonably necessary to produce, fulfil, deliver and support your order. We will not use a private personalisation image for unrelated advertising without your permission.
Personalised products and products made to your specifications may not be eligible for voluntary change-of-mind returns. Your rights remain unaffected if the product is faulty, damaged, incorrect or not as described.
- ORDERS
Submitting an order is an offer to purchase. We may accept, decline or cancel an order where reasonably necessary, including when:
• A product is unavailable
• Pricing or product information contains an obvious error
• Payment cannot be authorised
• We cannot deliver to the supplied address
• The order appears fraudulent or unlawful
If we cancel an order after receiving payment, we will refund the affected amount.
We may limit quantities where reasonably necessary. We will not make a material substitution without your agreement.
- PRICES, CURRENCY, TAXES AND DUTIES
Prices are displayed in the currency selected or available for your market. Exchange rates and fees charged by your bank or card provider may apply.
We provide free standard shipping on all orders, with no minimum purchase.
Taxes collected by us will be shown at checkout where applicable. International orders may be subject to import duties, customs charges or local taxes imposed by the destination country. Unless checkout expressly states that these charges are included, they are the customer’s responsibility.
- PAYMENTS
Payment must be made using a payment method offered at checkout. Payments are processed by Shopify and applicable payment providers.
You confirm that you are authorised to use the payment method supplied. We may delay or cancel an order if payment is declined or identified as potentially fraudulent.
- SHIPPING AND DELIVERY
Processing times, estimated delivery times, tracking, split shipments, customs information and delivery limitations are explained in our Shipping Policy.
Delivery dates are estimates rather than guarantees. If a significant delay or delivery problem occurs, contact us so we can investigate and provide any remedy required by applicable law.
You are responsible for checking that the delivery address is correct before submitting your order.
- RETURNS AND REFUNDS
Returns, cancellations, refunds and exchanges are handled in accordance with our Refund and Return Policy and applicable consumer law.
Nothing in these terms limits your right to a remedy when a product is faulty, unsafe, damaged, incorrect or does not match its description.
- INTELLECTUAL PROPERTY
The website and its original content—including branding, text, graphics, photographs, designs and logos—belong to us or are used with permission.
You may view the website and make purchases for personal use. You may not reproduce, distribute, modify, sell or commercially exploit our content without written permission, except where allowed by law.
- REVIEWS AND FEEDBACK
If you voluntarily submit a public review, testimonial, photograph or other feedback, you give us permission to display, reproduce and share it in connection with our store and marketing.
You confirm that public content you submit is accurate, lawful and does not violate another person’s rights. We may remove content that is unlawful, misleading, abusive, offensive or unrelated.
This does not apply to private photographs supplied solely to personalise an order.

We are not responsible for unrelated third-party websites that we do not control. This does not limit any responsibility we have for service providers acting on our behalf.

We handle personal information as described in our Privacy Policy. By using the website, you acknowledge that information may be processed by Shopify and other service providers required to operate the store and fulfil orders.
- PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may have separate conditions, expiry dates or eligibility requirements.
Unless stated otherwise, discount codes cannot be combined, redeemed for cash or applied retrospectively. Promotions do not affect your statutory consumer rights.
- WEBSITE AVAILABILITY
We aim to keep the website accurate and available, but uninterrupted access cannot be guaranteed. We may suspend access temporarily for maintenance, security or circumstances outside our reasonable control.

Customers may also have mandatory rights under the laws of the country or region where they live. Nothing in this section removes those rights or prevents a customer from using a court or dispute process available under applicable consumer law.
- SEVERABILITY
If any part of these terms is found to be invalid or unenforceable, the remaining sections will continue to apply.
